In the absence of political legitimacy, citizens have a moral claim to stay put and to be free from any legal interference; in other words, they may secede. John Simmons has cautioned me against alleging that it is inconceivable that samaritanism would prohibit emigration as well as secession. Because my account of political legitimacy draws upon the moral force of samaritanism, I must admit that emigration may permissibly be limited where such limitation is compatible with samaritanism. This may seem an awkward implication, but I suspect this is only because the circumstances would have to be radically counterfactual for this to be so.

According to the specificationist, then, Dale’s right to life does not conflict with Chip’s right to self-defense, because in this potential conflict there is an exceptive clause in Dale’s right that gives him no advantage in these particular circumstances. So despite initial appearances, there is only one right and, consequently, no rights conflict. The prima facie theorist describes the relationship between Chip and Dale differently. She allows for rights conflict, but suggests that this conflict does not eliminate either right.

If I am right that samaritanism is required to justify the state, the question of political legitimacy forces us to make a watershed choice. On the one hand is the rigorous libertarian position that allows a person absolute and unlimited personal autonomy as long as her conduct does not harm others, and on the other is a characterization of agents as liable to having their moral dominion curtailed by the peril of others. I have no deductive proof for samaritanism, but I can offer a prima facie case for the benefit principle and then defend this stance against the arguments of the libertarians.
